On August 5, 1991, the Hearing Examiner of the Madison Equal Opportunities Commission issued Recommended Findings of Fact, Conclusions of Law and Order in this matter. The Hearing Examiner determined that the complaint should be dismissed because of the Complainant's failure to appear at the scheduled hearing. The Complainant filed a timely appeal and the parties were afforded the opportunity to file arguments on appeal.

Based on a review of the record, the Commission enters the following:

ORDER

IT IS HEREBY ORDERED that the Hearing Examiner's Recommended Findings of Fact, Conclusions of Law and Order are upheld.

Based on the Commission's finding that the Complainant had failed to comply with requirements of the scheduling order and the briefing schedule, the Commission ORDERS the complaint dismissed.

Commissioners Anderson, De La Torre, Houlihan, Johnson, King, Ruben, Sowatzke, and Szwaja all joined in entering this order.
