Compliance Report

Madison Department of Public Health
Madison Department of Public Health (MDPH) re-established the Tobacco Vendor Compliance Check Program in 2001in order to decrease the availability of tobacco to minors. The Department has contracted with Centers for Prevention and Intervention (CPI) to perform one compliance check on each tobacco vendor in November and December of 2001. According to State statute, bars and taverns were included in these compliance checks.
According to data from the City Clerk
=s Office, there were 321 licensed tobacco vendors in the City as of November 2001. Nine of these licenses were not included in the compliance check program for one of several reasons (2 were not open to the public, 1 specialized in adult entertainment, and 6 were no longer in business).Key Points:

Compliance rates decreased among all tobacco vendor types over the 2 years that tobacco vendor compliance checks were not performed in Madison.·

Compliance Check Results:
Between July 1999 and November 2001, tobacco vendor compliance checks were not performed in Madison due to changes in state statute. For this reason, it was not surprising that compliance rates decreased in Nov/Dec 2001 to 69% (Fig. 1). The name, location, and record of vendors selling tobacco to a minor in this last round are provided in the appendix.
In 1998 and 1999, vending machines were not accessible to youths performing
compliance checks because Madison’s TVCP program did not send compliance
checkers into areas restricted to minors. With the change in state statute, our
program is now required to send minors into bars and taverns. As with compliance
checks in 1995 through 1997, compliance checks during this last round found
vending machines to have the lowest compliance rates of all types of tobacco
sales (Figure 2). As expected, all forms of tobacco sales experienced a decrease
in compliance from previous years.
Figure 3 (attached) shows the percent compliance broken down by vendor type for the last four rounds. Most vendor types experienced a decrease in compliance in the last round of checks with drops of 20 percentage points or more occurring at retail stores, liquor stores, and grocery stores. The large drops in compliance at restaurants are a result of the small number of these establishments checked in 1998 and 1999.

Enforcement actions taken in 2001 include mandatory tobacco vendor training and citation for the first sale after training or in a 12-month period. The numbers of enforcement actions taken from 1996 through 2001 are given in Table 1.
The following table shows the number of tobacco vendors in each alder district and details the number of vendors checked and the number that sold in November or December 2001.
