Dustin Kyle Dunlavy, age 28, Madison
Mr. Dunlavy was arrested and tentatively charged with Battery and Disorderly Conduct.

Perpetrator #1 is described as a male, white, 6', wearing a dark colored jacket, and riding a Trek Time Trial bike with front-style handlebars.

Perpetrator #2 is described as a female, white, 5'4", riding an Orbea Road bike with orange on the front.
Victim Male, age 51, Madison
Victim complained of head and rib pain but was not transported to a hospital.

On Wednesday afternoon, shortly after 4:00 p.m., (12/3/2008) a Madison Police officer arrested Dustin Kyle Dunlavy on tentative charges of Battery and Disorderly Conduct. Mr. Dunlavy had been contacted outside his West Olin Avenue residence about the November 26th battery. Dunlavy acknowledge he had gotten into a confrontation with the victim, but denied he threw him to the ground, or kneed him in the ribs. He says the two got into a pushing match, and that he did grab the victim by the head. He did not believe this would cause pain as the victim was wearing a bike helmet. Dunlavy was asked why he did not just simply ride away following the, "Get a light" comment. He said he felt extremely insulted by the statement, and did not think anyone had a right to tell him he should have a light on his bike.

On November 26th at around 6:30 p.m. Madison Police responded to a home near Lakeside Street after a bicyclist battered another bicyclist. The victim said this all started as he was biking along South Shore Drive. He says someone from behind notified him that he would be passing on the left. The victim moved over and a man and a woman biked passed. As they did the victim said, "Get a light." The male turned and asked what he just said, and the victim once again suggested, "Get a light." This led to a confrontation during which time the male and female yelled loudly at the victim to mind his own business. He says the male even tried to run him off of the road. The duo followed the victim to the driveway of his home where a conversation about lights continued. The female commented that the victim seemed to have plenty of lights and asked for one. The victim handed one over, and said at that point he did not feel threatened. However, he said the woman’s companion was still upset about the original comment and proceeded to clamp his hands around the victim's head. He twisted the victim to the ground, and kneed him in the ribs. The victim says he last saw the two cyclists peddling down South Shore Drive.
