Daryl A. Birkholz, 47-year-old male of Waupun, Wisconsin
CHARGES: Operating A Motor Vehicle While Intoxicated, Operating A Motor Vehicle With A Prohibited Alcohol Content, and Operating A Motor Vehicle After Suspension (DL)


On February 4th, 2012 at approximately 4:12am, The Dane County 911 Center alerted area officers of a vehicle driving erratically on Hwy 151 from Sun Prairie into Madison. The dispatcher also advised the officers that the suspect vehicle was reported to have jumped a curb, struck a pole, and was driving through the grassy area of the M&I Bank near East Towne Mall. Officers arrived within the vicinity, and located a 2009 silver Ford Focus that was driven by Daryl Birkholz. Birkholz stated he had recently consumed two beers, but was unsteady on his feet, and having difficulties maintaining his balance. Officers allowed Birkholz the opportunity to perform field sobriety tests, and the officer asked if Birkholz knew the English Alphabet. Birkholz advised that he did, as he had graduated from college, but when this test was attempted by him, he was said to have hesitated for an inordinate amount of time and stated “Oh God, I’m done” after his recital attempt. Officers took Birkholz into custody, and his blood alcohol content reflected .33! This value was four times the legal level of operation, and officers immediately conveyed him to the Dane County Jail on all charges above.
