Incident Report for Case #2013-39829

Incident Type

Traffic Arrest

Incident Date

02/11/2013 - 2:06 PM

E. Washington Ave. @ Lexington Ave.

Leland R. Schmidt, age 44, Madison
Mr. Schmidt was arrested for Operating a Motor Vehicle While Impaired - 2nd offense.

The driver had his foot on the brake and was asleep behind the wheel. A citizen alerted police to the situation Monday afternoon after looking into the suspect's pickup truck, which was stopped on busy E. Washington Ave. at the intersection with Lexington Ave. A responding officer opened the driver's side door quickly and placed the truck in park before turning it off. The driver awoke and said he had fallen asleep due to it being too hot in the cab. However, even after he was out in the winter air, he continued to fall asleep while standing and trying to talk with the officer. A bottle of Oxycodone pills was found in the cab. It appears the driver has a prescription, and later admitted he had fallen asleep several times Monday after consuming the drug.
