CHARGES: Operating While Intoxicated-1st Offense, Operating Without Valid Drivers License and Failure To Obey Traffic Sign or Signal


On 11/26/2013, a Madison Police Officer was on routine assignment in the downtown area.  As he travelled westbound on W. Gorham Street, he was immediately surprised by the sight of headlights coming directly at his squad car.  The officer initiated his emergency lights, but the suspect vehicle continued to approach the officer on the one way street.  The officer stated that the head on collision was only averted because the suspect swerved around the police car.  The officer then turned around and attempted once again to stop the suspect, but the suspect continued to drive a considerable distance before coming to a final stop near N. Broom Street.

The officer contacted Jessica Tolbert, and she thought the stop by police was due to her excessive speed.  Tolbert seemed to have no inclination that the stop was for something much more significant, as the officer did not note a speeding infraction.  She was given the opportunity to perform sobriety tests, and after opting to not exercise that option, demanded police let her go back to her vehicle.  Officers smelled the odor of intoxicants, and immediately conveyed her to The City County Building for OWI processing.  Tolbert then proceeded to scream, continuously spat at officers, and made an allegation that officers pulled her wig off of her head.  Tolbert denied ever operating her vehicle, nearly crashing into a squad car, and told officers that she was arrested while being in a bar.  Tolbert was conveyed to the Public Safety Building on all charges listed, as accounts of what transpired were viewed dramatically different between Tolbert and police.
