A Madison Police Sergeant was on a specialized assignment in the downtown entertainment district. The primary focus of this assignment is largely to reduce violent level street crimes, and ensure the safety of all citizens; understanding the challenges that alcohol can create. The sergeant was driving down University Avenue, and saw an intoxicated female had walked out into the middle of traffic. Several cars had to slam on their brakes, narrowly striking the female identified as Rebekah Brandt; as she was described as having difficulty moving across the street. She stumbled in front of skidding vehicles as they attempted to avoid colliding with her body.

The sergeant contacted the female, and she continued to tell police to leave her alone. With her safety being the primary concern, officers attempted to get Brandt into their vehicle, but Brandt physically resisted. She attempted to kick the sergeant, and at one point started to spit at officers. Brandt was immediately taken to the Dane County Jail, and her only response to routine questions asked of her by officers was "Eat feces"; although other selective words were used.
