Wisconsin Supreme Court Decision, New Local Order, Anyone Can Get a Free Test

The Wisconsin Supreme Court struck down the state's stay at home order just after 5 p.m. yesterday.

In a 4-3 decision, the Supreme Court struck down the statewide Safer at Home Order.  In their ruling, the Court held that the order issued by the DHS Secretary was in fact a rule and therefore, the Secretary was required to follow the rule making process outlined within Wis. Stats. Sec. 227.

Under Wis. Stats. Sec. 252.03(1), a local public health officer may "take all measures necessary to prevent, suppress, and control communicable diseases.  Therefore, Janel Heinrich, Director of Public Health Madison & Dane County, immediately issued an order, which is found below.  This order adopts all of the provisions of the Safer at Home Order, with one exception: religious entities are now treated as an "essential business" under the order and allowed to open as long as they are following the guidelines outlined within the order.


The RESPONSE

Effective immediately, Public Health Madison and Dane County just issued this local order. Dane County Adopts the Following:

ORDER OF PUBLIC HEALTH MADISON & DANE COUNTY

DATE OF ORDER: MAY 13, 2020

Please read this Order carefully. Violation of or failure to comply with this Order is a crime punishable by fine, imprisonment, or both. (Wis. Stats. §§ 252.03 & 252.25) and a violation of Dane County Ordinance §46.25(1) and Madison General Ordinance §7.05(6) punishable by forfeiture.

I hereby adopt the provisions contained within Emergency Order #28, Safer at Home Order, a copy of which is attached hereto and fully incorporated herein, except for the following:

1. Section 13.h – entitled "Wedding, funerals and religious entities" is amended to remove religious entities from the subsection.

2. Section 13 aa is created entitled "Religious entities". Religious entities must follow section 2.b.

I hereby adopt the provisions contained within Emergency Orders #34 and #36, INTERIM ORDERS TO TURN THE DIAL, copies of which are attached hereto and fully incorporated herein.

UNDER THE AUTHORITY OF WISCONSIN STATUTE SECTION 252.03, THE PUBLIC HEALTH OFFICER OF THE CITY OF MADISON AND DANE COUNTY ORDERS that the provisions of Emergency Orders #28, #34, and #36 are reasonable and necessary for the prevention and suppression of the COVID-19 disease in the City of Madison and Dane County, and are hereby adopted as an Order of Public Health Madison Dane County. This order is effective immediately, and shall remain in effect until 8:00 a.m. on Tuesday, May 26, 2020.

THE NUMBERS

As of 9:30am, yesterday there are 491 people who have tested positive for COVID-19 in Dane County, up 8 from this time yesterday morning.

Since the Alliant Energy Center community test site opened on Monday, over 1,000 people have been tested. As results start to appear in the dashboard, keep in mind a big jump in cases doesn't mean things have gotten worse in Dane County. We know there were people in Dane County with COVID-19 who had not been able to get tested. Substantial increases in the number of people who test positive for COVID-19 reflects changes in who is able to be tested as well as the ability of laboratories to process tests.

Wednesday, 528 people were tested at the Alliant Energy Center.


RACIAL DISPARITIES DOCUMENTED: Racial disparities heightened with COVID crisis

According to the U.S. Census Bureau, African Americans make up 6.7% of Wisconsin's populations, but they account for 29% of the people who have died in the state from COVID-19, higher than the national number of 21.9%. Blacks
make up 21%
of the COVID-19 cases statewide.
 

Testing Available for Anyone at Community Site

Anyone can now be tested for COVID-19 at a free community testing site at the Alliant Energy Center. Public Health Madison and Dane County have the following information for anyone who wants the test:

  • Location: 1919 Alliant Energy Center Way, Madison, WI 53713
  • Hours: 8 a.m.-4 p.m., Monday-Saturday.
  • No appointments or pre-registration is necessary.
  • No ID is required.
  • Drive-thru, bike-up or walk-up
  • Spanish and Hmong translators are available onsite.
