CDC Eviction Moratorium Extended
CDC Eviction Moratorium Extended to October 3 in Counties with Substantial or High Rates of Community Transmission
Update from Legal Action of Wisconsin:
The CDC has issued a new order extending the moratorium on evictions due to non-payment of rent for 60 days, through October 3. The Order is limited to counties with substantial or high rates of community transmission. Dane County is currently at a substantial rate of community transmission so the extension currently applies here in Dane County. If a county no longer is listed at a substantial or high rate for 14 consecutive days, the moratorium will not apply. If a county is not currently at a substantial or high rate, but reaches that rate, the moratorium will apply at that time. Here is the CDC COVID Data Tracker where you can track that information.
In order to qualify for protection under the Order, you will have to have served a declaration upon your landlord attesting to a number of facts. The Tenant Resource Center has a declaration toolyou can use to determine whether you are eligible and send a declaration to your landlord. You also need to apply for government assistance available to you. TRC is currently administering the Dane CORE program, which allocates federal emergency rent assistance funds, and you can apply online at https://core.tenantresourcecenter.org/. Urban Triage is currently providing assistance to people in completing applications and will be administering rental assistance funds, as well, next month. That information is available at their website. https://form-usa.keela.co/community-rental-support-sign-up-form
There are several exceptions to the order that allow landlords to proceed with eviction for tenant misconduct or contract violations for reasons other than non-payment.
If you are in eviction court, you should file a copy of your declaration and the new order with the court and request the court dismiss the case due to the CDC moratorium extension. IF you are facing termination of tenancy or eviction in Dane County and would like free legal aid, you can apply for assistance by calling Legal Action's intake line at 855-947-2529. Whether or not we will be able to represent you in your case will depend on your eligibility for our services, the facts of your case, and staff availability at the time of your request.
Please share this information with your networks. The CDC moratorium is only helpful to tenants if they are aware of the order's protection and no how to invoke it.
