UDC To Consider 400 Block of State Street Proposal on June 29

JD McCormick Properties' proposal to redevelop 428 to 444 State Street will be before the Urban Design Commission on Wednesday, June 29. The developer proposes to demolish the existing three mixed-use buildings and construct a new five-story (six stories including loft units), mixed-use building with 23-26 primarily studio apartments and a first- and second-floor commercial space with 34 bike stalls and no car parking. They are seeking Demolition Permits for the three existing buildings and will need advisory approval from the UDC and formal approval by Plan Commission. The Common Council will also need to approve the requested Certified Survey Map that would combine the current lots. You can find the project plans, land use application, and other UDC materials, including the staff report, here.

The UDC's purview is limited mostly to the exterior design of the proposed building and its conformity to the Downtown Urban Design Guidelines and to the Design Standards for Downtown and Urban Zoning Districts, MGO 28.071(3). City staff has raised some concerns about the proposal's impact on the adjacent Lisa Link Peace Park and some issues related to UDC's design review (see staff report). As mentioned, UDC is considered advisory to the Plan Commission on these matters unless Plan Commission asks for a formal recommendation. On July 11, Plan Commission will consider the Demolition Permit Application and requested Conditional Uses. 

Back on Jan. 31, 2022, the Landmarks Commission considered the requested demolitions of the three buildings. The city staff report on these buildings is here. As with all proposed demolitions in the city, Landmarks provide advisory findings to Plan Commission who makes the decisions on demolitions. For the building at 440-444 State Street Landmarks found that (paraphrased) it has historic value related to the vernacular context of Madison's built environment, but the building itself is not historically, architecturally or culturally significant. For 432-436 and 428-430 State Street (2 buildings) the Commission found that (paraphrased) the buildings have historic value based on architectural significance, cultural significance, historic significance, and/or its status as a contributing structure in a National Register Historic District.

The steering committee of the Mansion Hill District of Capitol Neighborhoods, Inc. (CNI) that has evaluated the redevelopment proposal has not yet issued its report.

Red Rock Rooftop Terrace Proposal

Also at UDC on June 29 - Proposed 2nd Floor Terrace at Red Rock Saloon

Also at Wednesday's Urban Design Commission meeting, the proposal to add a 2nd floor rooftop terrace atop the Red Rock Saloon at 222 W. Gorham Street will be considered. The proposed terrace would be accessed from current second floor interior spaces via two new garage doors and two standard doors. The deck would be approximately 1,450 square feet and its occupancy is estimated at 82 patrons or perhaps more.

Red Rock Saloon is also required to obtain a Conditional Use Permit for this outdoor area from the Plan Commission. That is expected to be at the July 11 Plan Commission meeting. If you'd like to give input on the proposal, please email me at

The applicant is proposing to shut the two garage doors at midnight each night to reduce noise and allow patrons on the terrace until 1:30am. There would be no amplified or non-amplified music on the terrace and no outdoor bar. I anticipate that noise mitigation options and concerns will be discussed at UDC, as well as at Plan Commission. MPD has also raised concerns about any potential interaction between those on the terrace and those in the City's Buckeye Parking Lot or otherwise on the ground, as well as a need to understand the security, safety, and management plans for the terrace. I imagine those concerns will discussed mostly at Plan Commission.

July 7 Neighborhood Meeting on a New Redevelopment Proposal for 100 Block of N. Butler St.

On July 7 at 6:30pm, please join me for a virtual neighborhood meeting to take a first look at a proposed redevelopment of 117, 119, 121-123 & 125 North Butler St. The developers, Reese Fisher and Blake Fisher, propose to demolish the three existing apartment houses (shown above) that are currently located on these properties; one lot is vacant. Proposed is a new four-story building with 32 market rate apartments comprised of studios, 1-bedroom, and 2-bedroom units that will include a rear roof terrace as a resident amenity space. A below grade level will provide 24 parking spaces for vehicles, 3 spaces for mopeds, and 35 spaces for bicycles.

The developer proposes to convert the four existing properties into a single lot and seeks a rezoning from Downtown Residential 1 to Downtown Residential 2. One consequence of this proposed rezoning would be that the building's width would have no maximum, unlike the current DR1 zoning's maximum width of 60 feet. The rezoning will need approval by the Plan Commission and Common Council with any Conditional Uses needing only Plan Commission approval.

Sometime after the July 7 meeting, the James Madison Park District of Capitol Neighborhoods, Inc., (CNI), will likely form a neighborhood steering committee to further evaluate the proposal. Registration for the meeting is required and available here.

Authorizing the Mayor and City Clerk to enter into a sole-source emergency contract with Fiscal Assistance, Inc. to facilitate the provision of housing assistance-related payment services using federal HOME Tenant-Based Rental Assistance (TBRA) funds, to supplement resources that support participants of the City's Unsheltered Response Initiatives programs.
Fiscal Note
The proposed resolution authorizes a sole source contract with Fiscal Assistance, Inc. to facilitate the provision of housing assistance-related payment services. The will be effective through June 30, 2022 and is not to exceed $420,000. The contract will be funded using federal HOME Tenant-Based Rental Assistance (TBRA) funds. No additional appropriation is required.

Authorizing the Mayor and City Clerk to execute contract amendments with specific Dane CoC agencies to extend ESG-CV contract terms through December 31, 2022.
Fiscal Note
The proposed resolution amends existing contracts with multiple community agencies providing homeless services by extending the contract end date from April 30, 2022, to December 31, 2022. The contracts are funded through Emergency Solution Grant Program Supplemental Funds (ESG-CV) and were originally approved by the Common Council through RES-20-00733/ File ID #62438 and RES-21-00199/ File ID # 64390. Agencies have not fully expended funds The extension will allow them to fully and effectively utilize funds. No additional appropriation is required.

Approving the Building Improvement Grant Program, authorizing Economic Development staff to manage and market the program to independent business owners consistent with approved program guidelines, and authorizing the Mayor and City Clerk to sign grant agreements with the selected business owners.
Fiscal Note
No additional City appropriation is required for the proposed resolution. $500,000 was authorized in 2021 by the Common Council through RES-21-00487 (File ID 65935). Additional funding is available through the 2022 EDD Capital Budget (SBER, MUNIS 13072) and the 2022 TID 50 State and Lake Capital Budget (MUNIS 99012).

Authorizing the Mayor and City Clerk to execute a subcontract with Slipstream for a grant from the U.S. Department of Energy (DOE) Connected Communities program in the amount of $1,157,855 effective May 1, 2022 to April 30, 2027 for implementation of Grid Interactive Efficient Buildings (GEB) strategies in 5-6 municipal facilities.
Fiscal Note
The proposed resolution authorizes a subcontract with Slipstream for a grant from the U.S. Department of Energy (DOE) Connected Communities program for implementation of Grid Interactive Efficient Buildings (GEB) strategies in 5-6 municipal facilities. The amount of the grant is $1,157,855 and is effective May 1, 2022 to April 30, 2027. Activities in 2022 related to the grant will consist of in-kind staff time for information gathering. No appropriation is required at this time.

Repealing Section 10.085 Entitled "Outdoor Lighting" and Creating Section 29.36 Entitled "Outdoor Lighting" of the Madison General Ordinances. to the Five Principles of Responsible Outdoor Lighting
From the Proposed Ordinance:
Purpose and Intent . This ordinance regulates all outdoor lighting installed on residential site and commercial site property, both publicly and privately owned within the City of Madison with the exception of outdoor lighting on public streets, public bikeways and public walkways which are regulated elsewhere in the ordinances. The purpose of this ordinance is to create standards for outdoor lighting that do not interfere with the reasonable use of commercial site and residential site property, that prevent light trespass and conserve energy yet maintain night time safety. Installation of outdoor lighting is not mandatory but if installed, it shall be in conformance with the provisions of the ordinance, the building code and all other codes and regulations as applicable and under appropriate permit and inspection.

Approving the Creation of the Project Plan and Boundary for Tax Incremental District (TID) #50 (State and Lake), City of Madison.
Fiscal Note
No additional City appropriation is required with the approval of creating TID #50 and the proposed project plan. The 2022 adopted capital budget includes $600,000 for PCED projects supported by proceeds from the TID. Additional city costs associated with urban development in this area will be included in future operating and capital budgets subject to Common Council approval.
