Highlights:  At Finance on Monday, the committee will go into closed session to discuss the city's litigation strategy in response to the lawsuit filed by the developer of the Judge Doyle Square project. The Plan Commission continues their review of comments on the comprehensive plan on Monday. Last Thursday the PC reviewed the letter from SASY with their recommendations. I have requested a summary from Planning staff of the PC decision that I will share. Also Monday, meet the new owners of Star Liquor regarding their application for a Class A license to sell packaged goods. The Historic Preservation Plan Advisory Committee meets Tuesday. The drone ordinance I am co-sponsoring will be at Public Safety Review Committee Wednesday. At TPC on Wednesday, the commission will discuss increasing parking permit fees, changing Metro routes 37 and 38 and closing bus stops on Rutledge near the Yahara River, more info in the links below. The MPD Policy and Procedure Ad Hoc committee is meeting Thursday.  I cancelled plans for a neighborhood meeting for the Winnebago Arts Cafe once it became clear they do not need Plan Commission approval for the proposed restaurant-nightclub, see the update at the end of the blog.

6. 51821 SUBSTITUTE - Authorizing the Madison Police Department to accept a Center for Children's Law and Policy grant for technical assistance, training and $10,000 to support the planning and implementation of strategies to reduce racial and ethnic disparities in arrests of youth; and amend budgets accordingly.

 

10. 51861 Authorizing the Mayor and City Clerk to execute loan agreements associated with affordable housing development projects selected as part of the 2016 Affordable Housing Fund Request for Proposals process.

 

Fiscal Note:  The proposed resolution authorizes execution of Affordable Housing loan agreements, totaling $1.8 million, with Gorman Holdings, Inc. for GrandFamily Apartments and MSP Real Estate, Inc. for Normandy Square. The loan amount to Gorman Holdings will be $950,000 for a 60-unit rental housing development with 56 affordable units. The loan amount to MSP Real Estate, Inc. will be $850,000 for a 58-unit rental housing development with 48 affordable units. Adopted RES-16-00854 (File ID 44932) authorized allocation of $3.15 million from Affordable Housing Funds, part of which was to support the aforementioned developments. The proposed loans will be covered by $10.7 million of available appropriation in the Affordable Housing Fund capital project in the Community Development Division.
 

15. 51875 Approving Facade Improvement Grant to Holly Alexander for a project located at 308 S. Paterson Street. 

 

16. 51872 SUBSTITUTE - Authorizing the Acceptance of a Brownfields Grant from the Wisconsin Economic Development Corporation (WEDC) and amending the 2018 Adopted Capital Budget to accept and appropriate the total grant amount of $472,000. 

 

Fiscal Note: The proposed resolution authorizes acceptance of a $472,000 Brownfields Grant from the Wisconsin Economic Development Corporation. The 2018 Adopted Capital Budget includes $1,825,000 of funding for Garver at Olbrich Botanical Complex project within the Parks Division, these funds will serve as the required matching funds. No additional City appropriation is required. If adopted, total funding for the project will be $2,324,000.

17. 51623 Amending the 2018 Capital Budget and Authorizing the Mayor and City Clerk to execute a development agreement to fund a $2,600,000 Tax Incremental Finance Loan, funded by GO Borrowing, to University Research Park, Inc. or its assigns to assist in the renovation of approximately 48,316 gross square feet of existing office, construction of approximately 137,874 of new office and approximately 472 parking stalls located at 501 Charmany Drive Place to be occupied by Exact Sciences Corporation as an office headquarters and innovation laboratory within the boundary of TID #46 (Research Park).

Neighborhood Meeting- meet new owners of Star Liquor

Michael Randall, Troy Armbruster, Josh Swentzel and John Conowall have an accepted offer for the purchase of the Star Liquor building, 1209 Williamson Street. They plan to apply for a Class A Beer and Liquor license and re-open Star Liquor under the same name to sell liquor, wine, beer, tobacco, snacks, etc. Their proposed hours are 9:00 a.m. - 9:00 p.m., seven days a week. Please join us for a neighborhood meeting to learn more about their plans.

DRAFTER'S ANALYSIS: This proposal adopts certain provisions of state law relating to the regulation of drones, and creates civil forfeitures for violations of the provisions. This proposal prohibits the operation of a weaponized drone except by military personnel acting in their official capacity, based on Wis. Stat. § 941.292. It prohibits the use of a drone to photograph, record or otherwise observe a person in a location where the person has a reasonable expectation of privacy, except by a law enforcement officer authorized under Wis. Stat. § 175.55(2), and is based on Wis. Stat. § 942.10. This proposal also adopts a provision of state law, Wis. Stat. § 114.04, which makes it unlawful to land a spacecraft or aircraft on the lands of another, without the person's consent, and makes it unlawful to fly a spacecraft or aircraft so low as to interfere with the existing use of the lands or water, or flying a spacecraft or aircraft so to be imminently dangerous or damaging to persons or property lawfully on the lands or water beneath.

F.1. 51586 Amending Section 12.138(11) of the Madison General Ordinances to increase the fees for residential parking permits. 

 

The proposed ordinance change increases the permit fee for a residential parking permit from $28 to $42 annually and increases the fee charged for the issuance of duplicate permits from $7 to $11 annually.  The amended ordinance will take effect beginning with the purchase of 2018-2019 residential parking permits (August 2018).

 

In the 2018 budget, the Parking Utility's salary and benefit expenses increased $395,000 to reflect the cost of the Parking Enforcement Officers (Police employees) enforcing the Residential Parking Permit Program and other time restriction parking regulations. These costs had historically been reflected in the Police Department's budget.The Parking Utility's 2018 adopted budget includes $130,000 in residential parking permit revenue and $85,000 from a transfer from the General Fund to offset a portion of the Parking Enforcement Officer's salaries.  It is anticipated the increased fee will generate $57,000 in additional revenue, bringing the total to $272,000. The annual expenses of the program are $540,000.

To fully fund the program by permit revenue, the Parking Utility has estimated the annual permit fee would need to increase to $105. The anticipated annual revenue increase of the ordinance change is $74,000.??

Future Commission Items:

 

1. The Long Range Planning Subcommittee is likely to approve a draft version of the Park and Open Space Plan (POSP) over the next month or so. Staff anticipates bringing this to the Park Commission in July. 

2. Staff will be presenting a general overview of the work on planning for the future of Golf to the Golf Subcommittee in June. Staff anticipates having further discussions with the Commission in the fall of this year.  

3. Community Service staff are working on an update to the Parking Ordinance for Parks and are hopeful to be able to use this as an opportunity to create a legal framework related to parking in Parks that is more consistent, transparent, and promotes voluntary compliance with parking regulations. 

4. Community Services staff are also working with Food Policy staff on a pilot program related to food procurement processes. 

5. Planning and Development staff will present an overview of the Capital Budget and planned projects for 2019 in September or October after the Mayor releases his Capital Budget. 

6. Bids were opened on Breese Stevens Concession and Restroom Addition on May 24th; only one bid was received which significantly exceeded the budget. The contract is scheduled to be rebid in July.

Update

 

Winnebago Arts Cafe - 2262 Winnebago Street - delay meeting. During planning staff review, it was discovered that the proposed restaurant-nightclub is actually a permitted use in NMX zoning (neighborhood mixed use). The Zoning Code Supplemental Regulations for restaurant-nightclubs state: "A Restaurant-Nightclub is a conditional use if established after the effective date of the ordinance and is open between the hours of midnight and 5 a.m.". Since this establishment will be closing at midnight, it is a permitted use. The applicant will need to obtain an entertainment license through the Clerk's Office and a liquor license through the ALRC and Common Council, so there will still be opportunity for neighborhood input, but this project does not require Plan Commission review. I will hold a neighborhood meeting but later in the summer.
