Highlights: The topic of dogs in parks will be at Monday's Parks Long Range Planning Subcommittee. Creating the special task force on PFAS will be at the Common Council Executive Committee on Tuesday. Also on the Common Council agenda for final approval Tuesday is the ordinance to expand permissible terrace planting and to allow for raised beds. Several temporary licenses for upcoming festivals and events at ALRC Wednesday. The calendar shows a special separated license renewals meeting on Thursday. In June all licenses, except those excluded for additional review this month, will be adopted. On Wednesday, the Urban Forestry Task Force is presenting their final plan - the work of D6 residents helped push this initiative forward. On Thursday I am holding the second neighborhood meeting with Alder Verveer about the Essen Haus properties. The project is now called the East End. The McGrath Group will show renderings based on community, committee, staff and alder feedback (see details below).

The opportunity to receive curbside yard waste collection this spring has ended. Residents should take the material to one of the Streets Division drop-off sites at 1501 W. Badger Rd, 4602 Sycamore Ave, and 402 South Point Rd. They are open 8:30am until 4:30pm on Mondays, Wednesdays, Fridays, Saturdays, and Sundays. The sites are open 8:30am until 8:00pm on Tuesdays and Thursdays.

RIDE THE DRIVE 2019 is Sunday, June 2 from 11:00 am to 3:00p. The 11th annual Ride the Drive is a free event where the city closes roads to traffic and provides family-friendly activities, entertainment, food and fun at three downtown area parks. GREGORY W. GELEMBIUK (6th A.D.)  - appoint to the position of Member. Mr. Gelembiuk is a scientist in the field of evolutionary biology, ecology and genetics. In addition, he has a background in public health models for public safety and is a member of the Community Response Team - a group of concerned Madison citizens working on policing and public safety issues. Mr. Gelembiuk succeeds Christian Albouras.

I am thrilled to see this appointment, Gregory's knowledge will be a huge asset as the committee finalizes its report.

DRAFTER'S ANALYSIS:  This ordinance creates a new category of land use known as Incidental Uses. 

The Zoning Code currently defines Principal Use as the "main use of land or buildings as distinguished from a subordinate or accessory use."  The Zoning Code also allows for accessory uses, which are defined as uses "on the same lot with, and of a nature customarily incidental and subordinate to, the principal use or structure and serving the occupants of the principal use or structure."  Thus, the Zoning Code contemplates that a building or structure will contain a single principal use and may contain accessory uses that customarily go with that principal use.   While mixed-use districts allow multiple principal uses on a single property or in a single building, those uses must be in separate units on the land or in the building and thus are treated similarly to single use properties with respect to the classification of principal and accessory uses. 

This amendment creates a new use category known as Incidental Uses.  It removes the word "incidental" from the definition of accessory use and defines incidental use as "a use that is affiliated with but subordinate to a principal use of land or structure."  Unlike accessory use, an incidental use does not have to be of the type customarily associated with the principal use.  Instead, it must be affiliated with the principal use, such as through common ownership.  Under this amendment, any principal use identified in the district use tables may also be an incidental use subject to the same use category (Permitted or Conditional) and same supplemental regulations, where applicable.

This amendment also recognizes there may be incidental uses that need to be specifically identified because there is no principal use that would apply.  An example of such an incidental use is the incidental sale of alcohol.  Over the last several years, staff has received numerous requests from business owners (primarily retail businesses) who want to supplement their business with the sale of alcohol to their customers.  Currently, however, there is no way to approve such a use without adding an additional "principal use" to the property.   Thus, this amendment also creates "Incidental Alcohol Sales" which would allow a property owner holding a class B license to sell alcohol to users of a principal use as long as the sale of alcohol does not exceed 25% of the gross receipts of the owner's uses on the land.  This zoning change has no impact on the separate issue of obtaining any needed alcohol license.

Mayor Rhodes-Conway visits Madison Metro Bus facility as part of Infrastructure Week May 13- 20

The Mayor will meet with staff, learn more about the solar PV project planned for the facility this year, hear more about the E-buses the City will add to its fleet and tour the
building to see the renovation underway to make the building more energy efficient and able to accommodate our new E-buses.

Mayor Rhodes-Conway is joining community leaders across the country to help educate the public on the importance of sound, energy efficient infrastructure and to advocate for additional federal
funding for these infrastructure needs.

Neighborhood Meeting #2 Essen Haus properties "The East End"

Please join Alder Mike Verveer and me for the second neighborhood meeting for McGrath Property Group's proposed new mixed-use project called "The East End," which will be situated on most of the properties currently owned by the Essen Haus (with the exception of the Hotel Ruby Marie and the four rental homes on S. Blair Street).  Updated plans will be presented at this meeting.  The proposed project will create approximately 180 residential units, 220 covered parking stalls and 10,000 sq. ft. of commercial space.  The project also proposes the demolition of the buildings housing most of the Essen Haus restaurant on 510-518 E. Wilson Street.  506 E. Wilson Street (housing the Come Back In) will be restored as part of this project.  McGrath intends to submit their formal Land Use Application for the project to the City on May 29, 2019.  Construction is projected to begin on October 1, 2019, with occupancy slated for April 1, 2021.
