Highlights: On Tuesday, the Common Council Executive Committee will discuss the resolution to create a joint City-County task force on PFAS. On June 21, the Wisconsin Department of Health Services, the Wisconsin Department of Natural Resources, and the Wisconsin Department of Agriculture, Trade and Consumer Protection announced recommendations for groundwater enforcement standards and preventive action limits for two PFAS compounds (PFOA and PFOS ) at 20 nanograms per liter (ng/L), or 20 parts per trillion. During testing in 2017, high levels of PFAS were detected in the immediate groundwater beneath the area at the Dane County owned Truax airfield where the Air National Guard (ANG) Wing #115 used firefighting foam containing PFAS in training sessions over many years and, also in 2017, the Madison Water Utility (MWU) tested five wells that are located near the airport or old City landfills for PFAS contamination. The tests indicated trace amounts of PFAS in Well 16 (near Mineral Point Rd. and a former landfill) and subsequent tests have found more significant levels and several types of PFAS at Well 15 on East Washington Ave. The Water Utility has continued testing for PFAS compounds, and by the end of 2019, will have tested all city wells and has temporarily shut down service at Well 15.
If you are not familiar with PFAS, according to the nonprofit and nonpartisan Environmental Working Group, per-and polyfluorinated substances "...are a group of chemicals that, because of their nonstick and heat-resistant properties, have been used since the 1940s in a wide variety of industrial and consumer applications. Exposure is associated with myriad health impacts, including cancer, kidney disease, ulcerative colitis, high cholesterol, preeclampsia, low birth weight and reduced effectiveness of vaccines. EWG recently identified 610 sites in 43 states contaminated by PFAS, including 117 military sites. EWG also identified nearly 500 industrial sites that are potentially discharging PFAS into the air and water. Because the military has required the use of PFAS in firefighting foams for 50 years, there is likely some level of PFAS contamination near virtually every military base, fire training center and commercial airport in America. However, because there are no requirements to test or monitor for PFAS, no one knows the true scope of PFAS contamination. Once in the environment, PFAS chemicals never break down. This means that even decades after PFAS are released, people will still be exposed and face health risks from these "forever chemicals" if contaminated sites are not cleaned up." https://www.ewg.org/news-and-analysis/2019/07/it-s-time-designate-pfas-hazardous-substance
The proposed task force will enable the City and County to gather information on remediation plans from affected agencies, identify knowledge gaps in our understanding of this persistent contaminant, provide a clearinghouse of information for the community, and make recommendations to the Common Council and the County Board to encourage a comprehensive response to contamination, enforcement and treatment options based on peer review of emerging science.
Several D6 alcohol license applications are on Tuesday's Council agenda, including Garver Green's license application for a Class B Combination Liquor & Beer and 21+ Entertainment License. The ALRC adopted the following recommendations at their June 11 meeting: 1. The establishment must close Sunday through Thursday by 11 pm and Friday and Saturday by midnight. 2. All outdoor space in the licensed premises must close by 10 pm 3. There must be no amplified sound outdoors. 4. The establishment must meet the definition of a restaurant under Section 38.02 of Madison General Ordinances at all times. 5. Food must be available at all times alcohol is served.
On Wednesday, at Board of Public Works, there will be an informational meeting and public hearing about 5G technology. The City of Madison is developing guidelines that will allow cellular companies to locate Small Cell installations in a way that maximizes technological benefits, while attempting to preserve street level aesthetics. Wireless companies plan to install antennas and equipment on poles on public streets. The meeting will go over the interim design guidelines and other requirements the City is considering to regulate the installation of the new facilities.
To support the growing need, wireless network providers are starting to install equipment known as "small cells," which are low-powered antennas that provide an area with higher data volume than the large towers, but in a much smaller area. Since the small cells serve smaller areas, the facilities need to be installed much closer together, serving only a couple of blocks in all directions. The small cell facilities typically are attached to poles within the right-of-way including new standalone poles, utility poles and street light poles. When the small cell is placed on a utility pole or street light pole, the existing pole must be replaced. The small cell equipment is allowed in the public right-of-way per federal and state law, just like utilities. Federal regulations have limited the City's ability to regulate but some regulation is still possible. More info below.
There will be a public information meeting on Thursday July 18 at 6p at Olbrich to learn more about the proposed Garver Path project. The City of Madison in conjunction with WisDOT and FHWA are proposing a project to construct a new path (Garver Path) between Sugar Avenue and Milwaukee Street. The proposed project will consist of constructing a multi-use path to improve access to neighborhoods, parks, and commercial areas by providing a connection between Milwaukee Street, Dawes Street, and the Capital City Path.

In anticipation of 5G implementation, and in response to recent orders of the Federal Communication Commission (FCC) and forthcoming State legislation, the City adopted ORD-19-00037 on May 21, 2019 (Legistar File No. 55033), which ordinance will create Section 10.053 Madison General Ordinances on August 1, 2019. This ordinance creates a new small cell facility permit, thereby providing the City with a process for managing, and uniform standards for acting upon, requests for the placement of wireless telecommunications facilities (Small Cell facilities) within the right-of-way consistent with the City's obligation to promote the public health, safety, and welfare; to manage the right-of-way; and to ensure that the public's use is not obstructed or incommoded by the use of the right-of-way for the placement of wireless telecommunications facilities.
Pursuant to Section 10.053(5)(b)1 of the small cell ordinance, and consistent with the FCC Orders and anticipated State laws, the City has developed guidelines that will allow cellular companies to locate Small Cell installations in a way that maximizes technological benefits, while attempting to preserve street-side aesthetics. Small Cell infrastructure will affect the function and aesthetics of public spaces. Moreover, there are numerous providers already operating in Madison. The end result is a significant demand upon a limited recourse. Cities across the nation are beginning to address the issue of balancing the need to accommodate increased cellular demand with their community's public space character and function. These guidelines build off of those efforts in a way that is appropriate to the needs of the City of Madison.
