Highlights: The Finance Committee will review CoHo Madison's request for HOME funds for 11 affordable owner occupied units as part of the Winnebago Street cohousing project on Monday. Finance will also discuss a contract with Nehemiah Community Development Corporation for peer support and crisis response services and the purchase and sale agreement with RDC Development for a gray box condominium for Pinney Library at Royster Corners and a Tax Incremental finance loan (TID 44) for phase 1 of Royster Corners. On Tuesday, the Public Safety Review Committee will discuss an ordinance that proposes new standards for reimbursing the legal fees of the police and fire chiefs in proceedings before the PFC and provides provisions to reimburse the legal fees of private individuals. There will be a joint meeting Wednesday between the Board of the Olbrich Botanical Society and the Board of Park Commissioners regarding the next phase of the Olbrich Botanical Gardens building expansion. 4. 47273 Creating Section 4.30 of the Madison General Ordinances to create a program for funding public art projects for certain public works projects.
DRAFTER'S ANALYSIS: This ordinance would create a program for funding public art projects whenever the City invests in a capital project meeting the criteria set forth in the ordinance. The ordinance would apply to certain enumerated public works projects whose anticipated construction costs exceed five million dollars. The funding for the arts would be in addition to the project budget and would not come from nor reduce the original project budget itself. Project budgets would be increased under this ordinance. The ordinance requires that an additional one percent be added to an eligible project's budget (by GO funds) for expenditure on art development at the project. The ordinance would allow, with Common Council approval, the expenditure of such funds at a site other than the eligible project under certain limited criteria and it would allow for the deposit of some or all such funds into the Art Aggregated Fund (for new art projects) or the Art Maintenance and Conservation Fund (for conservation and maintenance of the City's Art). These two segregated funds are established by this ordinance. The ordinance also allows the Common Council to reduce the amount of the arts funding under extraordinary circumstances but prohibits the complete elimination of this funding for the arts. The ordinance would also require that artists funded under this program waive any Visual Artists Rights Act (VARA) applicability so that the City has complete ownership and discretion over the location, display and maintenance of artwork acquired under this ordinance. The Arts Program Administrator shall file an annual report, with the Capital budget, that addresses the implementation of this ordinance. The ordinance would become effective beginning with eligible projects that are first let two years after the passage of the ordinance.

DRAFTER'S ANALYSIS: This ordinance repeals the resolution passed last year regarding reimbursement of legal fees and costs for the police and fire chief in proceedings before the Police and Fire Commission (PFC) and replaces it with the standards in this ordinance. It provides for reimbursement of legal fees by the City when a member of either the police or fire department successfully defends a complaint before the PFC, and establishes standards for determining success in the proceeding. This ordinance also provides that private persons who successfully prosecute actions before the PFC will have their fees reimbursed by the City. It similarly sets standards for measuring a successful prosecution.
The ordinance also provides that the Council may make adjustments in the fees to be paid if some claims are successful and others are not, including if the PFC finds a violation of standards but imposes no punishment. The ordinance does not affect reimbursement provisions in any agreements the City has with police or fire unions or employee associations, and it does not generally apply to court proceedings. In all instances where the ordinance or an agreement does not apply, the City retains its rights and obligations under state law to reimburse.?
