D6 Items of Interest Week of June 26, 2017

Highlights: This week is packed with district related items and a neighborhood meeting on Tuesday. At Finance on Monday, three items on Garver, a lease between the city and Goodman Community Center for the Brasswork's buildings use of city right of way, and a facade improvement grant for the Ideal Bar. Also on Monday, the Plan Commission will get a staff report on Imagine Madison and public feedback on general future land use maps. On Tuesday, Ped-Bike reviews the Darbo-Worthington-Starkweather plan (also at Community Services later in the week). I am organizing a neighborhood meeting on Tuesday about 2719 Hermina St. The owners of the East Side Shopping Center propose to add infill housing on the accessory parking lot behind the shopping center.

The Wednesday Board of Public Works agenda has several newsworthy items:704 Williamson St is before the Board for approval of Plans and Specs, there is an authorization to go out to bid for seating for the Central Park skatepark, the phosphorus treatment pilot at the Voit Farms is moving forward, the Fugitive Dust ordinance is recommended for approval, and there is an update about the sidewalk collapse in front of Monona Terrace. Also on Wednesday, Urban Design Commission will review the portable sign ordinance, Judge Doyle Square is up for final approval, review of public art for Cap East Garage, and an informational presentation on the proposed hotel and rehab of the Kleuter warehouse at 901 E Washington. Finally we are about to start phase 2 of "LORC" the landmarks ordinance review committee which will engage the public with the help of a consultant to review our city's five historic districts (three historic districts are in District 6). Our first meeting is Thursday.

6. 47641 Approving Facade Improvement Grant to Ideal Bar LLC. for a project located at 1968 Atwood Ave.


9. 47677 Authorizing the Mayor and City Clerk to execute a lease with Irwin A. and Robert D. Goodman Community Center, Inc. for a portion of the City's East Rail Corridor located adjacent to 214 Waubesa Street. The BOARD OF PUBLIC WORKS is scheduled to consider this item on 6/28/2017. The PLAN COMMISSION is scheduled to consider this item on 7/10/2017.


The proposed resolution authorizes execution of a lease with Irwin A. and Robert D. Goodman Community Center, Inc. for a portion of City property adjacent to 214 Waubesa Street. The lease will accommodate building encroachments and for use ancillary to community center operations. Annual rent payable for the first lease year shall be in the amount of $2,665.00 and shall be deposited into the General Fund (MUNIS charge code 63026). Rent shall be subject to a five percent increase every five years.


15. 47683 Authorizing a license between the City and Homburg Contractors, Inc. to deposit up to nine thousand (9,000) cubic yards of top soil on the "North Plat" in Olbrich Park, as a part of the redevelopment of the Garver Feed Mill. The BOARD OF PARK COMMISSIONERS is scheduled to consider this item on 7/12/2017.

16. 47696 Authorizing the City to enter into a sole source contract with SCS Engineers for professional environmental engineering services for the Garver Feed Mill site.

7. 47386 Determining a Public Purpose and Necessity and adopting a Relocation Order for the acquisition of land interests required for the construction and maintenance of the Starkweather Creek Coagulant Treatment System and associated facilities for urban water quality improvement...., amending the 2017 Adopted Capital Budget for the Stormwater Utility to appropriate $1,000,000 of general obligation borrowing and $320,000 of Stormwater Utility reserves for land acquisition, and amending contract 7405 with Brown and Caldwell for additional design services for the Starkweather Coagulant Treatment System. 

The Starkweather Creek Coagulant Treatment system at the Voit Farm is moving forward.


8. 47492 Creating Section 7.10 and amending Sections 1.08(3)(a) and 1.08(4) of the Madison General Ordinances to prohibit particulate matter to become airborne and establish bail amounts and grant the ability to issue citations for certain violations of the ordinance. 

This ordinance defines particulate matter and establishes policy expectations that it should be handled and stored to avoid becoming Fugitive Dust..


20. 47746 Approving plans and specifications for public improvements necessary for the project known as 704 Williamson Street - The Edge and authorizing construction to be undertaken by the Developer, Private Contract No. 7932. (6th AD) 

This is the project originally approved by the Plan Commission at Williamson and Blount St by Marty Rifken in 2014. (The one that Plan approved without showing actual front doors...)  Rifken sold the rights to Eric Fleming who made changes to the plan to meet the conditions placed on the project by the Plan Commission (showing doors, parking configuration, etc).  Natalie Erdman, the Planning Director, determined the design changes met the standards to be approved as a "minor alteration" and approved the project in 2015. She asked for my opinion and I recommended that it go back to Plan Commission for review since the changes, in my opinion, were not 'minor" but in consultation with Planning Division staff she decided to approve the changes to the plan as a minor alteration.  Fleming sold his rights to the approved plan to another developer, Forward Development Group and they are finally acting on the last step of the process and plan to begin construction.  I will get more information about the construction timeline and share it soon.

28. 47762 Declaration of Public Works Emergency for Failure of storm sewer pipe at Monona Terrace. 


...[T]he storm sewer under the walking entrance to Monona Terrace failed during last weekend (June 17/18). Investigation reveals that the storm sewer under this area was original construction circa 1880. The storm sewer was constructed of bricks and mortar in a pipe approximately egg shaped. This pipe appears to have followed largely the existing ground slope during its time of construction. As the area continued to develop and the retaining wall along the backside of the railroad along John Nolen was constructed (circa 1932) the pipe was buried further with the addition of more fill. When Monona Terrace was built in 1995 the area was further elevated. Currently the brick storm sewer varies in depth from approximately 9.25 ' to an estimated depth of approximately 20' at the point of failure. Repair of the storm sewer at this location would be exceedingly difficult, instead City Engineering will be rerouting the pipe to an existing drop shaft constructed as part of the retaining wall. This drop shaft will convey the water down and into the existing storm sewer at the base of the retaining wall. Further, with the reconstruction of West Wilson in fall of 2017 an additional bypass will be constructed to divert a portion of the water down to the storm system on Hamilton Street. 2. 46508 CHARTER Creating Section 31.046(2)(c) of the Madison General Ordinances to create a new permit system to allow portable, sandwich-board style signs in the public right-of-way. 


3. 46509 Amending Section 31.046(2) of the Madison General Ordinances to allow portable signs on public sidewalks and modify the allowable size of portable signs.

I introduced these companion ordinances after working with staff for several years.  We need to have a charter ordinance in order to address state law which prohibits signs in the right of way. The Mayor objects to portable signs and asked for referral at the last UDC meeting. He prefers no portable signs be allowed and says he will introduce an ordinance permitting wayfinding signs on city street sign poles (which he promised me he would do in 2011). If you think creating a legal framework for permitting portable sandwich board signs is reasonable in certain areas given the widespread (currently illegal) existence of these signs by establishing rules for size and placement, please consider sending an email to UDC commissioners. 3. 47423 Creating Sections 5.15 and 6.18 of the Madison General Ordinances to authorize the City to reimburse the legal fees of persons defending or prosecuting a claim before the Police and Fire Commission and repealing RES-16-00697, the City Police and Fire Chiefs Reimbursement Policy. DRAFTER'S ANALYSIS:  This ordinance repeals the resolution passed last year regarding reimbursement of legal fees and costs for the police and fire chief in proceedings before the Police and Fire Commission (PFC) and replaces it with the standards in this ordinance.  It provides for reimbursement of legal fees by the City when a member of either the police or fire department successfully defends a complaint before the PFC, and establishes standards for determining success in the proceeding. 

This ordinance also provides that private persons who successfully prosecute actions before the PFC will have their fees reimbursed by the City.  It similarly sets standards for measuring a successful prosecution

The ordinance also provides that the Council may make adjustments in the fees to be paid if some claims are successful and others are not, including if the PFC finds a violation of standards but imposes no punishment.  The ordinance does not affect reimbursement provisions in any agreements the City has with police or fire unions or employee associations, and it does not generally apply to court proceedings.  In all instances where the ordinance or an agreement does not apply, the City retains its rights and obligations under state law to reimburse.

This is the first meeting of phase 2 of "LORC". In phase 1 the committee recommended changes to the Landmarks Ordinance which were adopted by the Common Council. Phase 1 addressed general guidelines and policy. Phase 2 will establish a public process to gather resident input about each of the five historic districts with the goal of reviewing standards for demolition and new construction in each district and making recommendations to the Common Council. We will work with a consultant. This is an alder only committee consisting Alder Zellers, Alder King, Alder Clear, Alder Bidar and myself, staffed by the city Preservation Planner Amy Scanlon and Assistant City Attorney John Strange.
