Highlights: The developer interested in redeveloping 210 S Dickinson has concluded that a smaller building is not financially feasible and is no longer planning to pursue redevelopment at that location.  The Council on Tuesday will take up TID 37 funding for affordable housing at 134 S Fair Oaks (the Fair Oaks Nursery site). On Thursday, there will be a City Planning public meeting to discuss local historic district ordinances for the Marquette Bungalow District and the Third Lake Ridge district with city staff and our historic preservation plan consultant. I am working with the Mayor's office to appoint members to the Task Force on the Structure of City Government, we will be making an announcement soon. See the end of the blog for upcoming meetings.

Pennsylvania Park Public Artist Orientation Site Visit & Talks


Three finalists were selected to create an eye-catching piece for Pennsylvania Park. The Park is located at the corner of 1st St and Pennsylvania Ave on land created by the demolition of a house to incorporate a new bike path connection from the Yahara River bike path to the north side. The artists have been invited to Madison to meet with staff, neighborhood stakeholders, and the larger community. Artist talks have been scheduled for the artists to explain how they approach public art at the Downtown Public Library. Artists will be invited to dinner at Paqual's Cantina at 1344 E Washington Ave following their presentations.

2. 49672 Presentation: ULC Top Innovator Award for Race & Social Equity to Library Director, Greg Mickells and The Hip Hop Architect, Michael Ford, by Susan Benton, President & CEO of Urban Libraries Council for the Hip Hop Architecture Camp Program (Central Library).


The Madison Public Library is doing amazing work with the help of amazing partners! From the Urban Library Council website:  Created by architect Mike Ford, "Hip-Hop Architecture Camp" had two goals: to increase the number of minorities in architecture and urban planning and to retell the history of architecture and urban planning as it relates to Black communities. ...The library partnered with Ford, UW-Madison, MOD Media and others to host a four-day camp, where 50+ participants built an ideal community that will inform city planning processes. Some participants also created a song featuring the experience to share with the wider community and nationally at South by Southwest. These partnerships and this project allowed our library to work with new partners and actively inform our local urban planning processes.

I am excited that the Council is hiring a Chief of Staff for the first time. We selected Dr. Obeng from a pool of over 80 qualified applicants. He has experience as an Auditor and Performance Analyst in Chicago and Atlanta. He also worked as an Adjunct Professor of Political Science in Clark Atlanta University.  With his experience, we hope Dr. Obeng will help the Council strategically manage and plan for ways to address the needs of the city.

32. 47713 SUBSTITUTE - Requesting the City-County Liaison Committee to gather public input and make recommendations to the City of Madison and Dane County on possible locations to rename in honor of President Barack Obama.


33. 49217 Establishing a President's Work Group to Develop City-Wide Surveillance Equipment and Data Management Policies.


The President's Work Group on Police and Community Relations recommendations and report, adopted in May 2017, called for the Common Council to develop a city-wide policy for the purchase, use and management of data related to surveillance equipment. The City has an APM 3-17 which governs video camera surveillance but not all surveillance technologies are covered. This work group will use a racial equity and social justice lens throughout its work. The Common Council will develop this policy in consultation with City of Madison Information Technology, the City Attorney and all Departments or Divisions that currently use or plan to utilize any kind of surveillance equipment; and will include an inventory of all City of Madison surveillance equipment as of December 2017 and the surveillance equipment inventory will be updated annually.?


46. 49500 Amending Section 4.21(16) of the Madison General Ordinances to permit the disclosure of room tax data paid through lodging marketplaces, where such statistical data does not disclose the identity of particular returns.


DRAFTER'S ANALYSIS: Under Wis. Stat. § 66.0615(3), municipalities must adopt an ordinance protecting the confidentiality of information obtained from taxpayers of the room tax. This statute also provides an exception that a municipality may provide for the publishing of statistics classified so as not to disclose the identity of particular returns. In May 2017, the City entered into an agreement with Airbnb, where that company files a single return on behalf of third parties who offer accommodations through Airbnb's services. State statutes define a business such as Airbnb as a "lodging marketplace." This proposal would amend the City's existing ordinance to permit the City to disclose statistical data regarding the gross amount paid through lodging marketplaces, where the disclosure amount paid does not disclose the amounts paid by or the identity of the third parties who offer accommodations through Airbnb or a similar business entity.


49. 49554 Funding a Residential Solar Group Buy Program in 2018.


Fiscal Note: The 2018 Adopted Capital Budget includes $750,000 of GO Borrowing within Engineering-Facilities Management for the Sustainability Improvements program. The focus of the program is on implementation of the Madison Sustainability Plan via solar installations and energy efficient upgrades throughout the City. The proposed resolution authorizes a contract with RENEW Wisconsin for the development of a solar group purchasing program at an estimated cost of $32,000.


50. 49559 2ND SUBSTITUTE: Authorizing the allocation of up to $706,580 for use in supporting adult employment contracts, and up to $722,008 for youth employment contracts, amending the City's 2018 Adopted Operating Budget to authorize the transfer of $22,500 from funds budgeted for adult employment contracts to those budgeted for youth employment contracts, modifying the Community Services Committee recommendations with respect to specific adult employment contract awards, and authorizing the Mayor and City Clerk to enter into contracts with non-profit organizations selected through a Request for Proposals (RFP) process conducted by the Community Development Division to provide programming, beginning in 2018, that is geared toward preparing and connecting individuals with employment. 


The Council amended the 2018 Executive Operating budget to provide $150,000 in additional funds for youth and adult employment.


54. 49587 Authorizing the Mayor and City Clerk to execute a development agreement to fund a $322,000 Tax Incremental Finance Loan to 134 Fair Oaks, LLC or its assigns to assist in the development located at 134 S. Fair Oaks Avenue within the boundary of TID #37 (Union Corners).


In the recently adopted 2018 Capital Budget, TID 37 funding was approved for this project up to $343,000. The WHEDA applications are due December 8. When this item was introduced, a referral was added to Committee on the Environment. Unfortunately the CoE doesn't meet until January so I used my Council President perogative to put this on the agenda before CoE review in order to meet the tax credit application deadline.  While there may be outstanding concerns on air quality and nuisance issues at this location, I don't think there is any question that the city's TIF standards are met and 'but for' TIF there would not be any affordable housing at this location. According to the staff report: "The developer has proposed that 68 of the 80 units (85%) will be made affordable and therefore complies with this standard. The breakdown is as follows: 20% of the affordable units will be set aside for people whose incomes are at/below 30% of the county median income; 40% of the units will be set aside for people whose incomes are at/below 50% of the county median income; and 25% will be set aside for people whose incomes are at/below 60% of county median income." During the November 6 Plan Commission deliberations for 131 S Fair Oaks (Kessenich's site), John Hausbeck of Public Health mentioned that WDNR Air Permitting group would be looking at remodeling the Kipp facility in 2018. Everyone would welcome the news if the DNR decides to move forward on new modeling. 


55. 49610 Authorizing the Mayor and City Clerk to Execute a contract with AVA Civic Enterprises, Inc. for Project Director Services for the construction phase of the Judge Doyle Project and as Sole Source to act as City Agent for the Development of Judge Doyle Project. 


56. 49616 Selecting the Arts + Literature Lab (ALL) as the future occupant of the commercial space being constructed as part of the Capitol East Parking Structure and directing City staff to work with ALL on a term sheet.


67. 49283 SUBSTITUTE Identifying the Madison Public Market Foundation as the future operator of the Madison Public Market and directing City staff to work with the Madison Public Market Foundation Board on the terms of an Operating Agreement. 


This was referred at the last Council meeting with a request for the City Attorney to provide a memo about the relation of the nonprofit Foundation to the city. The memo is in the attachments.




79. 49683 Authorizing the execution of a lease with the Town of Blooming Grove of space within the building located at 3325 Thurber Avenue for use as an artist studio. ?


This location is at the edge of District 6.  Fiscal Note: The proposed resolution authorizes leasing building space with the Town of Blooming Grove to provide studio space for a commissioned artist to create a piece of permanent public art for the City of Madison. The "Initial Term" of the lease shall be three (3) years and the City will pay annual rent of $2,400 along with estimated monthly utility costs of $200. These expenses will be covered by the Municipal Art Fund, which has approximately $364,000 in available funds for the 2018 Adopted Capital Budget.

Please join me, Amy Scanlon City Preservation Planner and our consultants as we review and get feedback on the standards and guidelines for the Marquette Bungalow Historic District and the Third Lake Ridge Historic District.


This initiative is important and we need your involvement. As someone who has served on the city's Landmarks Commission since 2011, I often struggle with the uneven character of the different standards. Over the last several years, I have been involved in the phase one update to the Landmarks ordinance which strengthened our ability to preserve the city's historic resources and established the obligation of owners to maintain these historic resources in good repair. Now we are in phase two, where we will review the ordinance specific to each historic district and consider whether to maintain separate standards to reflect the unique character of the district or try to establish more consistent approaches to certain things such as new additions, windows, no vinyl siding, etc.

December 14- The OIR Group will present their report and recommendations about the Madison Police Department to the MPD Policy and Procedure Ad Hoc Review Committee. As Council president I am working on scheduling a joint meeting in January with the Ad Hoc committee and the Common Council to have additional time to discuss the report with the OIR Group consultants. Also in the works is a Town Hall meeting to share the report with the public, tentatively scheduled for January 25. More info as dates are firmed up.


December 19 - Public Information Meeting by City Engineering to discuss installation of canoe/kayak launch of cut limestone steps to access Starkweather Creek in the Darbo neighborhood. 5:30p Salvation Army 3030 Darbo Drive
