D6 Items of Interest Week of August 6, 2018

Highlights: I am going on vacation this week. I'll be hanging out at my family's cabin near the BWCA in northern Minnesota. I will not attend Landmarks, the Common Council Executive Committee or the Common Council meeting. At Monday's Landmarks Commission meeting, Grampa's Pizzeria has informed me and city staff they will be withdrawing their application for a certificate of appropriateness to construct an outdoor patio, they have also withdrawn their conditional use application at Plan Commission.  Also on Monday, the Common Council Executive Committee is holding a special meeting to interview and select a person to replace District 13 Alder Sara Eskrich who is taking a new job out of town. Thirteen candidates applied and the winning candidate will be appointed at Tuesday's Council meeting, along with the new District 19 alder Keith Furman. The appointment of two alders at once and three alders in the last two months, is historic. CCEC is likely to select a candidate who states they do not intend to run in spring 2019. I expect that D16, D19 and D13 will all have competitive races next year. CCEC meets Tuesday at its regular time and takes up the motor vehicle registration fee proposed by Mayor Soglin. I am interested in your thoughts on how to balance the option to create a new revenue stream versus the unequal financial impacts of a flat tax for low income residents. At the Council meeting on Tuesday, the D6 alcohol licenses introduced last month are on the agenda for approval. The big item is the Comprehensive Plan, city staff, city committees, neighborhood residents, and stakeholders of various stripes spent uncounted hours to update the plan. Hats off to all the people who showed up to craft a plan that is visionary and inclusive. As someone who represents historic urban neighborhoods in the central core of the city, I want to make sure we are increasing density appropriately throughout the city. I want to make sure we are creating walkable neighborhoods, served as much as possible with public transit, with places you want to go to. In my view, the edges of the city should be Urban, not Suburban.  Through the thoughtful leadership of District 2 Alder Ledell Zellers and the Plan Commission, the final version of the Comp Plan has been significantly improved. Finally, under intro of new business at Tuesday's council meeting, is the alternate to the alcohol moratorium. (#130)

5. 50110 SUBSTITUTE - Establishing a moratorium on issuance of new alcohol licenses in a high density, high police call area in downtown Madison and establishing a Task Force on Downtown violence. Sponsors: Paul R. Soglin 


6. 52042 Creating Sec. 12.177 of the Madison General Ordinances to establish a City of Madison motor vehicle registration fee. Sponsors: Paul R. Soglin 


The proposal would create a City of Madison Motor Vehicle Registration Fee of $17 as of January 1, 2019. The fee is anticipated to generate $3.3M and can only be used for transportation purposes per state law. The City would need to provide proper notice to the State of the ordinance's enactment no later October 2, 2018. If this ordinance is not adopted by the Council's September 4, 2018 meeting, the City may have difficulty meeting this requirement. 


The reduction of federal transportation dollars leaves a big hole in our budget and undermines our goals to increase Madison Metro's fleet, extend routes, and improve service. Unfortunately, the new motor vehicle registration fee, aka the "wheel tax" is required to be a flat tax due to the state constitutional requirement called the uniformity clause. "Article VIII, section 1, of the Wisconsin Constitution requires, in part, the uniform taxation of property. The section is commonly called the "uniformity clause" and was adopted as part of the original state constitution crafted by the 1848 constitutional convention, but arose from language debated during the first attempt at creating a constitution in 1846. The language ultimately adopted read as follows: "The rule of taxation shall be uniform, and taxes shall be levied upon such property as the legislature shall prescribe." [Joe Kreye, The Uniformity Clause, Reading the Constitution Vol 1 , No 2, Legislative Reference Bureau Oct 2016]. The uniformity requirement creates an unequal burden on low income residents. This proposal follows the county's approval of a $28 wheel tax adopted during their budget deliberations last November.  


The Transportation Policy and Planning Board recommended approval with recommendations on July 31. The Public Safety Review Committee made no recommendation on July 11. Finance is the lead.

Within areas of the City that are identified as being dense, the profile will examine if there are a disproportionate share of City services being delivered. The analysis will also include a comparison of the policies identified in MGO 28.127 with national best practices related to alcohol outlet density policies; and,


BE IT FURTHER RESOLVED, that this Staff Team will present its results to stakeholders who will use the findings from this analysis as the basis to develop recommendations for policy changes and/or ordinance changes geared towards the possible reduction of alcohol outlet density and accountability. The Staff Team will also offer recommendations pertaining to the sunset provision of MGO 28.127; and,


BE IT FURTHER RESOLVED, that the staff team will engage with the multisector stakeholders to inform its analysis. These stakeholders will include but will not be limited to;  members from Downtown Madison Inc.,  members from the Business Improvement District, members of neighborhood associations in areas where the alcohol outlet density analysis shows include a large number of alcohol outlets, members from the Downtown Coordinating Committee, members from the Public Safety Review Committee, members from the Alcohol License Review Committee, members  designated by the UW Chancellor, members of the Dane County Tavern League, members designated by the Associated Students of Madison, and Alders; and,


BE IT FINALLY RESOLVED that the Staff Team will provide an update on its work and any potential changes in policies and regulations by December 31, 2018

Then join me for a neighborhood meeting where we will learn about Jake and John DeHaven's proposal to open Winnebago Arts Café at 2262 Winnebago Street, formerly Sons of Norway. The establishment would have a capacity of 99 and would be open from 7:00 a.m. - midnight. The DeHaven's plan to serve breakfast, lunch, and dinner and to feature live performances of both local and touring acts from diverse disciplines. They have applied for Class B Beer and Liquor and Class C Wine licenses. The Alcohol License Review Committee will consider their application at its August 15 meeting.
