D6 Items of Interest Week of August 17, 2020
Highlights: Along with my colleagues on the Common Council, Mayor Rhodes-Conway and everyone in the city, I mourn the loss of an innocent child, Anisa Scott, a casualty of senseless violence. Madison is experiencing unprecedented gun violence. We have seen shootings between vehicles on public streets in broad daylight. Shots fired incidents are up 87% from this time last year (as of the first week of August). We have seen multiple vehicles and homes shot, shootings occurring in broad daylight, and in almost every metric relating to gun violence we have seen unprecedented increases. MPD will continue to do their part with these investigations but we need community leaders and organizations to unify, to work together, and to speak out against this rise in violence.
The final report? from the MPD Policy and Procedure Review Ad Hoc Committee had a specific and detailed recommendation, #40, that relates to developing a public health approach to violence with information about model programs like CURE Violence and others. Michael Johnson, CEO of The Boys & Girls Club of Dane County, sent an Open letter to the community with his recommendations.
Several years ago the city started funding programs that use a public health lens to address gun violence. One of the groups the city funds is the Focused Interruption Coalition which provides peer mentors to act as front line interrupters of violence. The mentors bring street cred and lived experience to make them credible messengers in helping mediate street conflict and reaching those at high risk of becoming the perpetrator or victim of violence. They try to help parties find alternative solutions to conflict that do not rely on violence and stop the further transmission of violent retaliation. Just Dane (formerly the Madison-Area Urban Ministry) is another organization the city funds that provides programs that works to help those formerly incarcerated to build better lives and reduce recidivism. These are important programs and we need to look at all the models out there. To get at the root causes, we need to address systemic impoverishment, racism and the trauma that results; and center the work in the communities themselves.
The upcoming 2021 budget will be very difficult, COVID has made a $10M-$20M dent in revenues. Every agency including the police, are being asked by the Mayor to provide an operating budget that shows a 5% cut. We will do the best to continue to invest in housing, childcare, neighborhood capacity building, youth programs and job training. It is not clear at this point, what impact the budget shortfall will have on staffing levels across agencies. We definitely need to be smart about how to use limited resources to add more community care and safety for the most vulnerable and reimagine how we want to be policed.
With the rise in shots fired incidents, some residents will be calling for more police officers. As a result of the demands around defending black lives, other residents will be calling to defund the police. Redirecting some public safety resources to frontline mental health emergency providers who can respond to certain types of calls for service makes sense and Fire Chief Davis has been working on the idea of a mental health ambulance for a couple of years but we need to figure out how to pay for staff and where to take people for mental health services. This budget will require a lot of tough decisions and we may not be able to move as fast as some people want, I hope you will be following and giving feedback.
Alders who serve the E Washington corridor from downtown to Milwaukee St have been receiving lots of complaints about drag racing and noise. As part of the city's Vision Zero initiative, this past weekend city staff from the Police Department and Traffic Engineering worked in collaboration to adjust the roadway options on E Washington and provide additional education and enforcement to motorists. One of the most noticeable changes will be that, beginning Friday evening, Traffic Engineering staff narrowed roadway segments by reducing lanes of traffic on E Washington to remind traffic to slow down to moderate speeds this weekend. You may have noticed some of the changes: Engineering Test lane closures on East Washington Avenue to physically slow down the racers and discourage the racing activities. Install turning restrictions at strategic locations to disrupt observed racing patterns. Observe the racing behaviors and identify locations for potential traffic signal operation change to further disrupt the racing activities. Education Utilize message boards to educate drivers and warn racers on enforcement initiatives. Enforcement Continue and potentially strengthen the enforcement operation on East Washington Avenue by utilizing Wisconsin Department of Transportation (WisDOT) Bureau of Transportation Safety funding. The police districts are also working to hold additional special initiatives to address the dangerous driving behaviors on the roadway. MPD will also be reaching out to other law enforcement partners for their assistance with traffic enforcement efforts.
The efforts to change behavior and driving conditions will be evaluated after this weekend and adjusted as needed.
Starting Sunday, August 23, Metro will increase its level of service. Due to budget constraints and staffing limitations, Metro is not able to return to the same level of service that was provided earlier in the year. However, as businesses and college campuses make plans to open in the fall, Metro must increase its current service level to accommodate as many riders as possible while its reduced bus capacity limits (20 riders per bus) are still in effect. Due to the tight timeline and overall uncertainty of the pandemic, it was not possible to hold a public hearing before making these service increases. A public hearing will be scheduled in the fall for riders to give input on the increases put into place. Depending on budget abilities and the current effects of Covid-19 at that time, route adjustments based on public comments may be made in early 2021.
Passengers are encouraged to provide feedback on this updated service. All feedback will be reviewed and taken into account during the public hearing process. Yahara Watershed Study Public Information Meeting - August 26, 6-8p Join the City of Madison to discuss the East Isthmus and Yahara River Watershed Study. The presentation from this virtual meeting will be recorded and posted on the project website. You must register in advance for the meeting on the project website. The watershed study will identify causes of existing flooding and then look at potential solutions to try to reduce flooding. The study will use computer models to assist with the evaluations. The City of Madison has hired a consultant, Tetra Tech, Inc to complete the first half of the study where the existing conditions are modeled. Now that I am no longer an elected official who is a candidate for a state office, I can resume sending my weekly blog to my 2100+ subscribers. You may have noticed you have not been receiving emails from me sharing this blog or other city news since March. I was following state ethics guidelines that prohibited me from sending more than 50 identical messages using public resources. I had been posting my blog on my alder update page on the city website but it may have seemed like I disappeared. I am back.

Staff report: At its June 1, 2020, meeting, the Landmarks Commission approved the applicant's request for demolition of the existing building at 817 Williamson and the combination of the lots at 817 and 821 Williamson. They provided feedback to the applicant on the proposed new structure and referred the project to a future meeting for a final decision. The commission reviewed the updated proposal at its July 13 meeting and referred the item to the next meeting with guidance to explore a two façade solution and address the height of the building at the street. The updated submission has two street façades with a slightly different rhythm of window and door placements between the two. The commercial façade is two stories with a third-floor balcony screened behind the cornice. The apartment façade is three-stories, but the applicant as reduced the height of the building down to 40'-7" from the original 41'-3". There is a cornice applied between the second and third stories on that façade. The cladding on the front portion of the building has returned to the darker red brick of the initial proposal. The spacing between the two façades is comparable to the spacing between the other buildings on this block face. The applicant has broken up the mass of the street façade of the building by creating two street façades and has reduced the height of the building at the street. Staff believes that the project as submitted meets the standards for new construction in the Third Lake Ridge Historic District. Please see the analysis in the previous staff reports.

Staff report: The applicant is requesting a Certificate of Appropriateness to construct an addition on the rear of the 909 Jenifer and a mostly below-grade connection between 909 and 911-915 Jenifer. Included in the application materials is the initial approval from the National Park Service as part of the preservation tax credit process. The rear addition would remove an existing open porch and stairs. The existing structure at 909 Jenifer has a wider area at the front of the building and then an inset single-story on the rear. The addition will add a second story to the inset area and then bump back out past the inset, which will allow the inset area to serve as the hyphen between the new and the old portions of the building and breaking up the wall plane. The windows on the new structure follow a similar placement pattern and are of a compatible style. The roof form is compatible, and the height of the addition will be just below that of the historic house. The applicant suggests possible metal roofing or asphalt shingles, but the NPS approval specifies asphalt or architectural shingles without heavy shadow lines. There is a discrepancy between the submitted plans, which show a 12" reveal on the clapboards, and the plans approved by the NPS, which show a 6" reveal. The 6" reveal would differentiate the historic from the new construction but be comparable to the historic resources. The 12" reveal would contrast with the historic resources. The basement-level connector will be minimally visible from the public right-of-way as the two buildings 3'-7" apart at their midpoints and 4' apart at the point of the proposed connection on the rear of the buildings. The connection is noted on the plans as a plinth. It is unclear how the plinth will appear above grade.
REQUEST FOR CERTIFICATE OF APPROPRIATENESS
6. 61543 911-915 Jenifer St - Exterior Alteration in the Third Lake Ridge Hist. Dist. - Replacement of porch railing; 6th Ald. Dist.
Staff report: The applicant is requesting a Certificate of Appropriateness to approve a railing on the front balcony of the house. The applicant received an administratively-approved Certificate of Appropriateness (CoA) on August 20, 2019, for repair of the existing newel posts and replacement of the nonhistoric metal railing with a simple wood railing (see attached). What the applicant installed was a different design that included a continuous top rail across the balcony, decorative spindles, and posts with spacing that differed from the pattern of the original. Staff's recommendation was that they could install what they had previously been approved for or submit an application to the Landmarks Commission to approve the style of railing they had constructed. Recommendation: Staff believes that the standards for granting a Certificate of Appropriateness are not met and recommends that the Landmarks Commission deny the proposal and the City enforce the 2019 Certificate of Appropriateness for the balcony railing.
7. 61590 504 S Brearly St (953 Jenifer St) - Exterior Alterations in the Third Lake Ridge Hist. Dist.; 6th Ald. Dist.
Staff report: The applicant is requesting a Certificate of Appropriateness to repair the existing roof; repair deteriorated stucco and wood trim with materials in-kind; replacing nonhistoric exterior doors with doors that replicate the style of an extant historic door; installation of wall-mounted lights flanking the main entrance; replace the existing skylight; remove existing wood siding on the 1877 wing and replace with smooth-surfaced vinyl siding that replicates the current clapboard exposure; remove a sign panel in a former window space on the bell tower and replace it with spandrel glass, and replace a nonhistoric ADA ramp. According to the preservation file, the existing building was originally constructed as the 3rd Ward School Building in 1877. That older portion has undergone the most extensive alterations and is the wing of the building clad in clapboard. In 1914, James Law (founding member of noted local architecture firm Law, Law & Potter) designed the stucco-clad Spanish Revival-style wing. The building has undergone changes over time and is currently home to the Wil-Mar Neighborhood Center. The more recent interventions were part of a 1994 Certificate of Appropriateness to rehabilitate the building, which included replacement of many of the existing windows. Most of the repairs are replacing materials in-kind and replicating existing deteriorated features. There are several nonhistoric exterior doors and the proposal is to replicate the style of an extant exterior door to provide more period appropriate doors on the building. The main double door will replicate the form of the other new doors, but have a glass panel instead of a plank panel. Historic photos show the arched window space on the tower as previously filled in with stucco and later with the signage placed over it. The outline of the former window space is evident and the proposed introduction of spandrel glass into this space will allow it to read as a window opening again. The current ADA ramp is deteriorating and no longer meets building code. It has a decorative motif of groupings of thin balusters to create a repeated pattern. The current railing is metal and the applicant is proposing to replace it with a wood railing that again creates a pattern of groupings of balusters. The railing is simple but does introduce a slight decorative element. Likewise, the new exterior light flanking the entrance is obviously modern, but is simple in style and compliments the style of the existing building rather than contrasting with it.

These amendments to project plans are the same items at Plan and Finance last week. The proposal is to amend the project plans for two TIDs to allow them to do additional projects, allow TID 42 in South Madison to accept donor funds of tax increment from TID 39, and use the half mile rule to include projects in a larger boundary. This initiative is in preparation for the coming annexation/dissolution of the Town of Madison in 2022. In addition, the city is planning to create a new TID once the Town of Madison comes into the city.
Tax incremental financing is a powerful tool for local governments to make investments in public (roads, green infrastructure) and private improvements (underwrite land costs, residential and mixed use projects, or parking) in a designated area. It is sometimes controversial, but generally tax incremental districts are created based on findings of blight and TIF plans that identify needed improvements. The "but for" test is used to determine whether investments should be approved by the city and affected taxing jurisdictions via the TIF Review Board. The municipality must show that "but for" the subsidy, the proposed new development would not happen. The WI Dept of Revenue sets the equalized value for property on an annual basis. The value of the TID is based on the equalized value amount at its creation and all future growth in property tax value (or increment) as determined by DOR annual reporting stays in the TIF district to be used for improvements for the life of the TID (up to 27 years) or until all the approved projects are completed and the TID is closed. The underlying base value is shared among all the taxing jurisdictions (city, county, school district, technical college) and Dane County, school district/MMSD and MATC/Madison College agree to give up the new incremental tax value for the life of the TID. Madison has a successful record of leveraging TIF funding to significantly increase the property tax value of these districts. Recent changes in state law allow a local municipality to keep the TID open an additional year after all funds for projects have been allocated and recaptured through incremental growth to use for affordable housing.
