AFFIRMATIVE ACTION MANAGER

CLASS DESCRIPTION

General Responsibilities:

This is responsible managerial and professional work in the coordination and administration of designated Affirmative Action programs, services, and staff of the Department of Civil Rights, to include: Contract Compliance, administration of the City’s Affirmative Action policies (M.G.O. 3.58), special emphasis recruitment, and associated services and reporting consistent with City-wide Affirmative Action goals and objectives. Under the general supervision of the Director of the Department of Civil Rights, the Affirmative Action Manager shall exercise judgment and discretion in meeting established goals and objectives.

Examples of Duties and Responsibilities:

Manage, coordinate, and administer designated Affirmative Action programs and services of the Department of Civil Rights. Manage assigned professional support staff to incorporate the full range of employee relations.

Manage the City’s Affirmative Action programs and services consistent with M.G.O. 3.58 and associated policies, procedures and standards. Provide related outreach, support, and training both directly and through subordinates. Oversee statistical record keeping systems/formats and associated obligations consistent with prevailing standards. Director and monitor the provision of related technical assistance. Direct a special emphasis recruitment program and provide related applicant support and assistance services.

Develop and recommend a wide variety of initiatives to the Director to forward the goals and objectives or assigned programmatic responsibilities.

Provide support and assistance to the Affirmative Action Commission, both directly and through subordinates. Serve as an ex-officio, non-voting member of the Affirmative Action Commission, if so designated.

Recommend budgetary, staffing, purchasing, and associated management/administration services to the Director.

Participate in the general management of the Department of Civil Rights as a member of the management team.

Develop and administer the City’s Contract Compliance Program. Ensure that outside vendors, suppliers and contractors are in compliance with Executive Order 11246, CFR 41 and MGO 3.58 as relates to affirmative action and equal employment opportunity. Develop and implement formal procedures in order to review Affirmative Action plans for compliance. Oversee and participate in the evaluation of workforce analysis and goals, and the identification and referral of candidates; and monitor progress towards achieving goals. Oversee and provide technical assistance to businesses in completing Affirmative Action plans; compliance reviews; and conciliatory measures.

Develop and administer monitoring systems. Prepare narrative and statistical reports. Conduct complaint investigation and review the procedurealized elements of this function.

Ensure that CDA and CDBG M/WBE Programs, Madison Metro DBE Program and Public Works Small Business Enterprise Program comply with federal, state and local regulations and ordinances pertaining to targeted business utilization. Oversee and participate in the review of plans and specifications to establish targeted business utilization goals on a project basis. Conduct pre-bid meetings. Oversee and provide prime bidders technical assistance in achieving goals; and the evaluation of prime bidders’ success. Make recommendations regarding bid rejection. Coordinate appeals process for bidders contesting rejection of their bid. Ensure that successful bidders comply with contractual obligation to targeted businesses. Administer certification process to certify eligible minority, women, disadvantaged and small business enterprises in compliance with applicable federal regulations and local ordinances. Perform complex analysis to ensure program integrity and validity of certifications. Administer annual recertification process to ensure that certification status is current. Develop systems to monitor ensure compliance, monitor and evaluate program progress and identify areas that need improvement. Provide narrative and statistical reports. Implement complaint investigation and review process.

Develop program enhancements and policy initiatives to meet programmatic goals and objectives.

Review and evaluate procurement practices to identify barriers to targeted business participation. Work to design procurement processes to maximize targeted business utilization. Identify goods and services utilized. Recruit targeted businesses to provides these goods and services. Develop monitoring systems to measure targeted business rate of contact, availability, utilization and reasons for not being utilized. Provide narrative and statistical reports.

Provide technical assistance to targeted businesses, in order to maximize their participation in City procurements, identify areas of need and develop their business and management skills. Provide referral to private and public financing sources and small business assistance providers. Develop and coordinate workshops designed to develop business and management skills of targeted businesses.

Develop and administer various grants. Provide liaison with various City Committees and Commissions, community based organizations, private and public sector small business resources and economic development agencies and federal agencies. Maintain an awareness of relevant legislation and other program considerations. Initiate programmatic changes to respond to changes as necessary.

Perform related work as required.

QUALIFICATIONS

Knowledges, Skills and Abilities:

Thorough knowledge of the principles and practices of affirmative action and equal employment opportunity, including relevant contract compliance systems and standards. Thorough knowledge of relevant State and federal laws, rules and regulations affecting affirmative action and their application. Working knowledge of purchasing and public works contractual processes. Ability to plan, direct and evaluate City-wide affirmative action functions and manage subordinate staff. Ability to effectively communicate both orally and in writing. Ability to analyze and address complex Affirmation Action issues and represent City interests. Ability to prepare and present complex written and oral reports. Ability to develop and maintain effective working relationships. Ability to make presentations to large groups. Ability to meet deadlines. Ability to maintain adequate attendance.

Training and Experience:

Three years of directly related leadership experience in the development, implementation, and administration of various (including construction contract compliance, vendor programs, and human relations programs) programs to promote equal opportunity and Affirmative Action objectives. Such experience would normally be gained after graduation from an accredited college or university with a Bachelor’s Degree in Business Administration, Public Administration, a social science or other related area. Other combinations of training and/or experience which can be demonstrated to result in the possession of the knowledges, skills and abilities to perform the duties of these positions will also be considered.

Necessary Special Qualifications:

Ability to meet the transportation requirements of the position.
