CLASS DESCRIPTION
General Responsibilities:
This is responsible managerial and administrative work in developing, directing, and coordinating the programs and activities of the City's Affirmative Action Department, both directly and through subordinates. The Affirmative Action Department is responsible for the City's multi-faceted Affirmative Action/Equal Employment Opportunity (Title VII), Service Delivery (Title VI), Contract Compliance (including Metro DBE program administration, related CDBG program compliance, Public Works and prevailing wage compliance), Disability Rights, contractor, vendor/purchasing programs and related AA/EEO training programs and the City's related Informal Complaint and Resolution Process. This work is characterized by considerable independent judgment and discretion in planning, administering, coordinating and implementing departmental functions and participating in the development and implementation of related City-wide policies. This position functions under the general direction of the Mayor.
Examples of Duties and Responsibilities:
Manage the staff, programs and functions of the Affirmative Action Department. Provide overall leadership in the development and implementation of citywide affirmative action (AA) policies and programs, and provide policy direction, interpretations and integration of relevant local, state, and federal legislation and guidelines. Participate in the development of related City policies. Establish and implement program priorities. Surface and address relevant policy issues (e.g. the incorporation of new or revised federal laws into current AA initiatives, guidelines and policies).
Oversee the development, approval and implementation of City affirmative action plans and programmatic and numerical initiatives. Direct and assist staff in the communication, interpretation, modification and negotiation of AA guidelines, procedures and standards with City agencies.
Develop Affirmative Action programmatic and planning standards. Oversee and/or develop related statistical record keeping systems/formats. Direct and monitor the provision of AA technical assistance. Develop and submit the citywide five (5) year Affirmative Action Plans and submit to the Mayor, Affirmative Action Commission, and Common Council, integrating numerical goals and timetables with hiring, retention, promotion and training of affected class members (i.e. racial/ethnic affirmative action groups, women and individuals with disabilities). Receive, monitor and report on compliance efforts and seek positive change. Develop and recommend policy on the resolution of alleged discrimination and harassment of City employees and administer the complaint procedure. Conduct and/or oversee related investigations pursuant to MGO 3.58. Work with City managers and legal counsel (internal and external) in addressing City issues.
Oversee the development and implementation of the City's Contract Compliance Program, in order to ensure compliance with applicable federal, state and local regulations relative to small business enterprises (SBE), disadvantaged business enterprises (DBE), and minority (MBE) and women business enterprises (WBE). Establish policies and procedures to maximize targeted business participation in competitive bidding. Develop applicable policies and procedures in keeping with program goals. Provide guidance, direction and oversight to the Fire Department in response to the Office of Federal Contract Compliance Program (OFCCP) mandates. Oversee and/or provide related training and direct technical assistance efforts. Oversee/direct the development of related data sources and reports.
Direct the development, implementation and oversight of the City Prevailing Wage Program by ensuring that contractors and subcontractors performing work on private projects receiving City financial assistance, e.g., (TIF, CRLF, IDB, COA) comply with state and local statutes and ordinances. Direct the development, administration and implementation of the targeted business Joint City/County Certification Process.
Provide leadership in the development, coordination and implementation of a citywide Disability Rights Program (in conformance with the ADA of 1990, the Rehabilitation Act of 1963, Section 504, MGO 3.72 and MGO 4.23 Assurance Plans) to ensure that no qualified person with a disability shall, by reason of such disability, be excluded from participation in, be denied the benefits of, or be subjected to discrimination by City facilities, or under any program or activity which receives or benefits from City financial assistance. Provide guidelines and interpretation on departments AA plans on issues of Disability Rights. Regulate and develop the creation and distribution of reports, brochures, and newsletters regarding people with disabilities. Conduct related public hearings. Direct the establishment, development, implementation and monitor the creation and distribution of uniform, comprehensive planning guides in conformance with the ADA for vendors and suppliers. Review submission and approval of all CBO's AA Plans.
Develop, recommend and implement policies and procedures to assist departments in complying with Title VI (Equal Access to Pubic Services) of the Civil Rights Act. Direct the development of related records and reports. Review and approve departmental submittals of Title VI plans for compliance. Monitor compliance efforts and seek positive change. Work to resolve issues both proactively and through the administration of an informal citizen complaint procedure.
Develop and direct program activities including training seminars to assist City managers and City contractors in ensuring compliance with applicable federal, state and local laws.
Administer related training programs pertaining to equal employment opportunities, affirmative action MGO 3.58, MGO 3.62, MGO 3.72, MGO 4.23, Section 504, Title VI (Equal Access to Public Services), Title VII, the ADA, anti-harassment in the workplace, diversity, etc.
Direct the development and administration or the City's Informal Complaint and Resolution Process. The Director conducts investigations, interviews witnesses, obtains and reviews relevant documents, drafts preliminary and final investigation reports, and prepares final investigatory reports.
Oversee, establish, develop, implement and monitor the creation and distribution of uniform, comprehensive planning guides in conformance with Rehabilitation Act of 1963, 504 Plan and ADA 504 Plan for vendors and suppliers (CBO's). Interpret, analyze requirements of Section 504 for City agencies who receive federal funds. Develop uniform standards in accordance with 504 regulations. Coordinate citywide efforts to assess City Departments compliance. Address, develop and plan for implementation programs, policies, procedures to address barriers. Advocate for funds as needed. Oversee/perform related administrative activities.
Hire, train, manage, and evaluate staff both directly and through subordinate supervisors. Develop and administer the agency budget. Develop and direct the accomplishment of office goals and objectives. Oversee the development of relevant information systems and reports.
Provide technical assistance and support to various City policy bodies.
Direct the provision of related contractual services provided to external agencies (e.g. US HUD, Dane County, Federal Transit Authority, Madison Area Technical College, Madison Metropolitan School District, etc.).
Meet and develop partnerships with various external bodies to enhance and promote equal employment opportunity and affirmative action throughout the Madison community.
Perform related work as required.
QUALIFICATIONS
Knowledges, Skills and Abilities:
Thorough knowledge of the principles and practices of affirmative action and equal employment opportunity. Thorough knowledge of relevant laws, rules, and regulations. Thorough knowledge of public administration principles and practices. Working knowledge of purchasing and public works contractual processes. Working knowledge of human resource management principles and practices. Ability to plan, direct and evaluate departmental functions and manage subordinate staff. Ability to formulate, recommend, and administer related City-wide policies. Ability to effectively communicate orally and in writing. Ability to analyze and address complex Affirmative Action issues and represent City interests. Ability to prepare and present complex written and oral reports. Ability to develop and maintain effective working and public relationships. Ability to maintain adequate attendance. Ability to maintain adequate attendance.
Training and Experience:
Three years of responsible leadership experience which includes primary responsibility for the development, implementation, and administration of various (including construction contract compliance, vendor programs, and human relations programs) programs to promote equal opportunity and Affirmative Action objectives. Such experience would normally be gained after graduation from an accredited college or university with a bachelor's degree in business, Public Administration, one of the social sciences, or an area related to the duties of this position. Other combinations of training and/or experience which can be demonstrated to result in the possession of the knowledges, skills and abilities necessary to perform the duties of this position will also be considered.
