How to Have Your Holiday Tree Collected

The Streets Division provides two rounds of curbside collection for Christmas trees. The first round began on January 2, 2020 with the second and final round beginning on January 21. Wreaths, evergreen rope, garlands, and boughs will not be collected alongside Christmas trees. Read more.

Jan. 6 Informational Meeting on Liquor License Application at Dark Horse

Please join me and the owners of Dark Horse for a meeting where we will hear about their application for a Class B Beer & Liquor license. The proposed license will be at their new restaurant at 10 N. Livingston (formerly Sujeo). Patrick DePula of Salvatore's Tomato Pies is proposing Dark Horse as a full-service restaurant. The projected hours are Tuesday through Thursday from 11am until 2pm and 4:30 to 10pm; Friday and Saturday 11am to 2pm and 4:30pm until 12am, and Sunday from 4 to 9pm. Dark Horse may also request extended hours on evenings when there are concerts at the Sylvee. At the informational meeting you will have the opportunity to ask questions, provide feedback, see their facilities, and learn about their business.

Alcohol Ban Issue in Reynolds Park to be Considered by TLNA Council on Jan. 9

 

Due to an increase in criminal behavior in Reynolds Park during the warmer months of 2019, TLNA Council and I both asked the Parks Department to enact a 90-day temporary ban on the consumption of alcohol at Reynolds Park. That ban was enacted, but has since expired. At their Jan. 9 monthly meeting (7pm at Festival Foods) TLNA Council will discuss asking for a permanent ban. The Parks Department can enact temporary bans administratively, but to permanently ban alcohol Common Council must enact a change to city ordinances. Ordinance changes that are district-specific are typically sponsored by the alder of the district, so I will be listening carefully to TLNA's discussion. Generally, I will consider the input of all neighbors when forming a stance on a neighborhood issue such as this. If you have input, I would like to hear from you, particularly if you cannot attend the Jan. 9 TLNA meeting.

Jan. 9 Steering Committee Meeting Continues Evaluation of 126 Langdon St. Proposal

 

The third steering committee meeting of neighbors evaluating Core Spaces' proposal for an apartment building at 126 Langdon St. will be held Thursday, Jan. 9, from 5:30 pm to 7:00 pm at Kennedy Manor, 1 Langdon St. Please take note of the new start time.

As currently proposed, the building includes 88 apartments with a total of 373 beds and 20 parking spaces, all contained in a 5-story building along Langdon with 7 stories in the rear. A large outdoor hot tub and deck are proposed atop the 5th floor building section. 

The developer has submitted their application for Conditional Use permits; plans to support the application are here. The proposal could change in the future as result of neighborhood input, Urban Design Commission (UDC) feedback, city staff input, and/or Plan Commission consideration, but that is TBD. The developer's first formal appearance at UDC could come as early as Feb. 12 with consideration by Plan Commission as soon as Feb. 24.

Redevelopment Proposed for 400 Block of E. Washington

LZ Ventures is proposing to demolish the Klinke Cleaners building, a house, an apartment building, and a single-story commercial building, all between 402 and 414 E. Washington, as well as three houses at 9 N. Hancock, 8 N. Franklin, and 12 Franklin. The developer proposes a 10-story market rate apartment building on E. Washington dropping to 8 stories in the rear with several levels of parking underneath. A commercial space is planned on E. Washington on the first floor.

 

District 6 Alder Marsha Rummel and I are hosting a Jan. 30 neighborhood meeting to discuss the proposal. Please email me if you have input and/or are willing to join a neighborhood steering committee that will form after the neighborhood meeting.

Note: This ordinance establishes new policies related to rentals such as Airbnb, VRBO, etc.

DRAFTER'S ANALYSIS: This ordinance creates a new requirement that individuals operating a tourist rooming house (TRH) obtain an annual TRH permit from the City. In the years since the City permitted tourist rooming houses the tourist rooming house agency has expanded and changed.  With this expansion, staff has experienced challenges enforcing TRH regulations, including specifically the requirement that TRH operators obtain a public health license, pay room tax, and comply with applicable zoning regulations.  Moreover, prospective TRH operators have expressed confusion over what regulations apply and who is responsible for enforcing them.  By creating an annual permit requirement, this ordinance centralizes TRH requirements in one ordinance.  Moreover, it requires TRH operators to submit documentation confirming compliance with applicable regulations and requires TRH operators to update this information on an annual basis.  Under the ordinance, failing to do either of these things can result in permit denial or revocation.  Further, this ordinance specifically provides for TRH inspections so that the Zoning Department can ensure that a TRH is being operated in a manner that is consistent with the documentation the operator has provided.  In the event that the operator violates any of the requirements in this permitting ordinance, the ordinance contains a process for revoking the TRH operator's TRH permit. 

 

This ordinance also makes several changes to existing TRH supplemental regulations contained in MGO Sec. 28.151, of the Zoning Code.  These amendments are necessary because as the TRH industry in Madison has expanded, it has become increasingly difficult for staff to enforce certain key provisions of the TRH regulations.  For example, two critical provisions of the current TRH ordinance are that 1) the TRH must be the operator's primary residence, and 2) a TRH operator may only rent the TRH for 30 days per calendar year if they are not present at the time of the rental.  The combined purpose of these two provisions is to ensure that the TRH operator is on premises the majority of the time a dwelling unit is being rented as a TRH and to prevent investors from purchasing properties for the sole purpose of renting out the entire unit as a TRH.  However, increasingly, staff is encountering situations where TRH operators either do not understand or purposely mislead staff with regard to whether a specific dwelling unit being used as a TRH is their primary residence.  Other TRH operators have either failed to keep a guest registry or have been reluctant to share the required guest registry, making it difficult or impossible for staff to determine if TRH operators are exceeding the 30 days of rental days per year when the TRH operator may be absent from premises. Finally, other TRH operators appear to be purchasing or leasing properties in Madison for the sole purpose of renting it as TRH.
